Marketing communications will be handled in accordance with applicable requirements. Commercial email communications will include an appropriate method to opt out of future marketing communications. Telephone and text communications will be subject to applicable federal and state requirements, including requirements that may apply to automated, prerecorded or telemarketing communications.

If a person asks Krivox not to contact them for marketing purposes, Krivox will take reasonable steps to honor that request. A request to stop marketing communications does not necessarily stop operational, security, transactional or service-related communications that are reasonably necessary.

Nothing in this Privacy Policy is intended to create consent where applicable law requires a specific form of consent that has not otherwise been obtained. Where a specific law requires prior express consent, prior express written consent, or another form of authorization, Krivox will rely on that required authorization rather than treating this Privacy Policy alone as a substitute for it.

Customer Instruction for Communications

Where Krivox is performing lead follow-up, CRM management, customer communications, appointment setting or similar services for a customer, Krivox may communicate with the contacts provided or authorized by that customer according to the customer's instructions and the applicable service agreement. The customer remains responsible for the accuracy, lawful source, permissions and communication instructions associated with its contact data.

7. Customer-Owned Data

Krivox provides technology and service solutions to businesses. A customer may enter, upload, connect or otherwise provide business information to Krivox systems.

Such information may include customer records, supplier records, employee information, leads, contacts, invoices, purchase orders, sales information, documents, communications, operational records, inventory information and other business data.

Customer data remains the customer's data. Krivox does not claim ownership of customer data merely because the data is stored, processed, transmitted or handled through a Krivox service.

The customer determines what information is submitted to the service and the purposes for which that information is processed, subject to the applicable agreement.

8. Service Provider / Processor Role

When Krivox processes personal information on behalf of a business customer, Krivox generally acts as a service provider, processor or similar contracted service provider, as applicable to the relevant law and agreement.

In that role, Krivox generally processes customer data only as necessary to provide the contracted services, maintain the service, provide support, maintain security, troubleshoot issues, perform requested integrations and follow the customer's documented instructions.

Customer responsibility: The customer is responsible for determining what personal information it collects, obtaining any notices, consents or permissions required for that collection and use, determining the lawful purpose for processing, and providing Krivox with lawful instructions for processing the information.

Krivox does not determine the customer's business purposes for collecting customer data merely because Krivox provides the technology used to process that data.

Where a customer agreement or data processing agreement imposes additional requirements on Krivox, those contractual requirements will apply to the customer data covered by that agreement.

9. Sharing and Service Providers

Krivox may use third-party providers to operate and support its business and services. These providers may include hosting, cloud infrastructure, security, communications, email delivery, analytics, authentication, database, backup, payment, scheduling, software and AI technology providers.

When third-party providers process customer data on Krivox's behalf, Krivox will use reasonable contractual and operational measures appropriate to the services being provided.

We may also disclose information where reasonably necessary to comply with law, respond to valid legal process, protect our rights or property, investigate security or fraud issues, or protect the safety of individuals.

If Krivox is involved in a merger, acquisition, financing, restructuring or sale of business assets, information may be transferred as part of that transaction, subject to applicable law.

10. Artificial Intelligence and Automated Services

Krivox provides AI assistants, AI agents, chatbots, RAG and knowledge applications, document AI, OCR, predictive analytics, generative AI integrations and other AI-enabled services.

Depending on the customer's configuration and service, information may be processed by Krivox technology and/or third-party technology providers to provide the requested functionality.

For customer-specific AI solutions, customer data is processed according to the applicable customer agreement and instructions. Krivox does not claim ownership of customer data merely because that data is processed by an AI-enabled Krivox service.

Krivox will not intentionally use confidential customer data to train a publicly available general-purpose AI model unless the customer has authorized that use in the applicable agreement or it is otherwise permitted by applicable law.

11. Cookies and Similar Technologies

Krivox may use cookies, local storage, pixels, tags, analytics technologies and similar technologies to operate, secure and improve its website and services.

These technologies may be used for essential website functionality, preferences, analytics, performance, security and, where applicable, marketing measurement or advertising.

Where applicable law requires consent for non-essential technologies, Krivox will provide appropriate controls.

You can also control certain cookies through your browser settings. Blocking some cookies may affect website functionality.

12. Data Retention

Krivox retains information for as long as reasonably necessary for the purpose for which it was collected, to provide services, maintain business records, satisfy contractual or legal requirements, resolve disputes, maintain security and protect legitimate business interests.

For customer data, retention and deletion are generally governed by the applicable customer agreement, service configuration and customer instructions, subject to legal and technical requirements.

Depending on the service, measures may include access controls, authentication, authorization, encryption in transit, encryption at rest where appropriate, logging, monitoring, backups, secure development practices and other security controls.

No internet transmission or electronic storage system can be guaranteed to be completely secure. Krivox therefore cannot guarantee absolute security of information.

14. Privacy Rights

Depending on where you live and which law applies, you may have rights concerning your personal information. These may include rights to:

  • Access personal information
  • Request correction of inaccurate information
  • Request deletion of personal information
  • Request a copy or portability of certain information
  • Opt out of certain targeted advertising or data-sharing activities where applicable
  • Opt out of certain profiling activities where applicable

Where a state privacy law applies to Krivox's processing, Krivox will provide the rights and disclosures required by that law.

New Jersey

The New Jersey Data Privacy Act applies to covered controllers and provides certain consumer rights concerning personal data. Where the Act applies to Krivox's activities, Krivox will provide applicable rights and required disclosures and will maintain appropriate processes for privacy requests.

Depending on applicable law, residents of states including California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, Iowa, Tennessee, Indiana, Kentucky, Maryland, Minnesota, Delaware, Nebraska, New Hampshire, Rhode Island and other jurisdictions may have additional privacy rights.

Our website and services may contain links to or integrations with third-party websites, platforms and services. Those third parties may have their own privacy policies and terms.

Krivox is not responsible for the privacy practices of third parties that Krivox does not control. We encourage users and customers to review the privacy notices of third-party services they choose to use or connect.

18. International Processing

Krivox is based in the United States and may work with customers, personnel, technology providers and business partners located in other countries. Information may therefore be processed or stored in the United States or other countries where Krivox or its service providers operate.

Where applicable law requires additional safeguards for international transfers, Krivox will use appropriate measures required by that law or applicable contractual arrangements.
